In our daily work, we witness that victims are often afraid to report violence, and a growing reason for fear of reporting is precisely the fear that institutions will accuse them of "alienation" and take their child away if they try to protect themselves from the abuser.

In the last two months, a series of articles by journalist Jelena Jindra entitled “A system for protection or for child abuse?” has been published on the H-alter portal.https://h-alter.org/ljudska-rights/system-for-protection-or-for-child-abuse/). Given that the articles in question by journalist Jindra present the testimonies of several women who warn of possible significant omissions and irregularities in the work of institutions that play an extremely important role in a large number of cases of violence committed within the family, we believe that it is necessary to investigate the validity of the same.

Letter Reaction of civil society organizations, which further argues our reaction and requests from the competent institutions, we sent to the Government of the Republic of Croatia, the Ministry of Labor, Pension System, Family and Social Policy, the Ministry of Justice and Administration, the Croatian Parliament, the Croatian Psychological Chamber, the Croatian Chamber of Social Workers, the Ombudsman for Gender Equality and the Ombudsman for Children.
Our demands are:
– that relevant state institutions and professional chambers seriously examine the allegations in the article and conduct an investigation into whether the rights of children and/or persons who have experienced violence in a partner relationship have been violated
– that the Ministry of Labor and Pension System, Family and Social Policy and the Ministry of Justice and Administration urgently organize education and professional training for persons involved in the systems providing support and protecting the rights of victims of violence, with an emphasis on understanding gender-based violence
– urgent reform of the social welfare system, which will, among other things, include improving the working conditions of employees, ensuring lifelong learning, education and supervision for employees, restructuring the system with the necessary new hiring of experts
– a strategic approach and intensive work to increase the sense of trust that citizens, including victims of violence, have in the justice and social welfare system, which will include changes to existing practices and external independent controls
– expanding the network and strengthening institutions that carry out complete diagnostic and treatment work with children and young people, especially when it comes to victims of violence, and ensuring their uniform territorial distribution

Udruga B.a.B.e. Budi aktivna.

Uz to, oštro osuđujemo uhodanu praksu dobrog dijela hrvatske zajednice koja gotovo uvijek u ovakvim situacijama stigmatizira i osuđuje ženu, a nikad muškarca.

The ruling in favor of Helena Crnojević speaks volumes about the position of women in Croatian society, as in this particular case, Helena was removed from the list of international referees by the Croatian Handball Referees Association because she decided to start a family. Helena was in the advanced stages of pregnancy at the time, and was removed from the list without any prior notice and despite the clear opposition of the European and World Handball Federations.

The BaBe Association held a press conference at which Bojana Guberac, on behalf of the association; Ines Bojić, attorney and legal advisor to the association, and Helena Crnojević spoke, regarding the verdict rendered in her favor by the Rijeka County Court on January 26, 2021, which finally determined that handball referee Helena Crnojević was discriminated against on the basis of gender, pregnancy and maternity by being removed from the international list of the Croatian Handball Referees Association, and for the same she was awarded compensation for non-pecuniary damage in the amount of 30,000.00 kn.

Helena contacted the BaBe association regarding her case in June 2016, which filed a complaint on her behalf with the Gender Equality Ombudsman, whereupon the Ombudsman determined that the specific case involved direct discrimination on the grounds of pregnancy and maternity, which is prohibited by the Gender Equality Act, and accordingly sent a recommendation and warning to the Association of Croatian Handball Referees and the Croatian Handball Federation, which, despite the warning, did not eliminate the discrimination. In the court proceedings against the Croatian Handball Referees Association, Helena Crnojević was represented by attorney Ines Bojić.

"In 2014, in my seventh month of pregnancy, my handball partner called me and said very upset that she had seen on our referees' association's website that we had been removed from the international referees' list. There was shock and disbelief, we couldn't believe they had done something like that while we were pregnant and we didn't know why?", Crnojević began about the discrimination she faced.

"I consciously and intentionally suppressed some feelings. I remember being in great shock, I remember being under tremendous stress, shaking, and having a painful stomach cramp. Getting a license to referee international competitions at the world level is a great honor that comes with years and years of training, matches, travel, sacrifices, and discipline – and when someone wipes all of that out in one day with one decision, it's like someone tearing down your entire world that you knew until then and stabbing you in the stomach at the same time. I remember being afraid for my baby that I was carrying in my belly, and I didn't want this stress that I was going through at that time to harm it in any way.", Crnojević told and warned, "And that's what they were counting on, what they were aiming for, they knew that as women in the most sensitive period of life, we wouldn't fight for our position at a time when we had to focus all our energy on bringing new life into the world.".

In late May 2015, after their applications to be reinstated on the international list were rejected, Crnojević and her partner in the court approached the Babe association, with the help of lawyer Ines Bojić and the Gender Equality Ombudsman. She warned the HRS and the HRS about the constitutional provisions, European regulations and Croatian laws regarding discrimination, and invited them to submit documentation denying such actions, and ultimately ordered Crnojević and her partner in the court to be reinstated on the international list of judges.

In 2017, after talking with a member of the UHRS board, Crnojević came to the conclusion that they were not aware of the consequences and meaning of their decision.

"It dawned on me then, if he doesn't know it, who is my generation, and how many others still don't know that a woman's position during pregnancy should not change and that she has the right to return to the same job she had before pregnancy after maternity leave. For me, the only logical decision was to file a lawsuit, and although I knew that it wouldn't help me personally, because court processes are too slow to help someone's career right now, I wanted this case, regardless of the outcome, to enter into court practice.", Crnojević explained her motivation.

After a three-year court process, she recounted her feelings in the following words and expressed hope that her case and verdict would make a positive change and protect pregnant women.

"I have to say that I felt the same painful cramp in my stomach every time I had to go to the hearing because I remembered all the events we went through in 2014 and 2015. And it wasn't always easy to listen to the reasons the other side gave to justify their wrong decisions.

As I mentioned before, this ruling means nothing to me personally and my career, but it should provide a foothold for all women who find themselves in a similar situation. I wanted to help all women who find themselves in a similar situation to be able to refer to this case and get some kind of legal foothold. So that they don't have to go through what I went through for four years, but with paper in hand I can say that this is not how it works.

Finally, I would just like to say to all women who want to continue playing sports, at the same level as before pregnancy, that they can now do so without fear that someone will take away their years of effort and work while they are pregnant or on maternity leave. They have the legal basis to continue in the same position they were in before pregnancy, and no one can dispute that right.

I hope that in the future, Croatian federations and associations will be proud of their wives and mothers and highlight them as excellent promoters on the international stage. Because they deserve it.", concluded Crnojević.

We congratulate Helena on the brave battle she fought and the justice we achieved together!

Iako B.a.B.e. Budi aktivna. Pružanje pomoći u slučaju tuđe tragedije smatramo svojom odgovornošću, no također smo osjetljive kada je u pitanju zaštita nečije privatnosti i dostojanstva.

Regarding the non-final judgment of the Municipal Civil Court in Zagreb and the decision on a temporary measure of the same court dated 28 November 2019, issued in the proceedings for the adoption of a decision on parental care between Mr. Milan Popović and Ms. Severina Kojić, which have been the subject of intensive media reporting, we hereby consider it necessary to express our concern about the radical move of the court reflected in the decision in question, which fundamentally changes the previous way of life of the minor child, and de facto significantly limits the mother's parental rights. It is stated that, according to the available information, the main reason for making such a decision is manifested in the parents' mutually impaired relations and disagreement in educational procedures, without any specific objection to the manner in which either parent exercises parental care, which, if proven to be true, represents a particularly worrying circumstance.

The above, especially considering that the manner of exercising parental care is also regulated by a temporary measure that is enforceable on the day of its adoption, which leads to the de facto separation of the child from the previous family environment and separation from the parents on the same day that the decision was communicated to the parties, with the absence of any preparation and adaptation of the child to the new life situation, which in itself shows all the shortcomings of the system and the lack of adaptation of the legal regulations that in this sense did not foresee any transitional period or support from experts in assimilating the child to the new circumstances and real life situations, and which omissions are most clearly manifested in the sphere of family relations. In this specific situation, the burden of preparing the child in one day for handover to the father fell on Mrs. Kojić, and if she had not done so - she would have suffered additional consequences. Additionally, despite opposing the court decision, we welcome Mrs. Kojić's decision to hand over the child to the father and thus protect him from trauma and stress in the event of forced enforcement.

At the same time, and regardless of the specific case, since it is not an isolated case, we would like to express our general concern about the decisive influence of the opinions of social welfare centers in court proceedings for the purpose of making a decision on parental care, whose proposals, according to our experience, are adopted by the courts in most cases without reservation, whereby the centers do not bear any responsibility for the opinions expressed, even when they are evidently contrary to the rights and interests of minor children. Moreover, they dismiss them under the pretext that they are not the ones judging, but the court, which on the other hand refers to the opinion of the center, which creates a vicious circle in which the consequences are borne exclusively by minor children.

Based on our many years of experience working with clients in similar life situations, we have witnessed continuous complaints about the shortcomings of professional assessments by individual social welfare centers, which in a significant number of cases, according to the clients, are based on the personal impression of the employees themselves, on the basis of which we can conclude that this is a frequent pattern of behavior, which we find extremely worrying. The above, especially taking into account that within the framework of the legal protection of children and families, there is no protocol for monitoring the execution of court decisions in family cases, through which the positive and negative effects of such court decisions could possibly be detected, which appears to be absolutely necessary.

We must also regretfully state that the role of special guardians, who were introduced into the system precisely with the aim of protecting the interests of children due to their overcapacity, has not resulted in the desired effects and in practice their position is purely formal in nature, as evidenced by the proceedings in question, in which, according to information available in the media, the special guardian did not see or speak to the minor child for a period of two years, whose interests she was supposed to represent in court proceedings. Consequently, the conclusion is that the fundamental rights of the child guaranteed by the Family Law and the Convention on the Rights of the Child to express an opinion in proceedings that directly concern his or her rights and interests have not been ensured.

In conclusion, we appeal to all participants in the system to seriously and promptly approach finding an adequate legal solution in order to ensure that court decisions in parental care proceedings are based on professional and independent assessments and that the preparation of such assessments is entrusted to sufficiently educated, sensitized and expert persons, as well as to regulate adequate mechanisms of accountability of persons who make such assessments and to establish a system for monitoring the execution of court decisions and their effects in practice, all with the aim of protecting the rights and interests of minor children.

Based on the experience of numerous of our clients during the many years of operation of our Legal and Psychosocial Counseling Center, we would like to emphasize that the case of Mrs. Kojić is only the reason for this announcement, with which we want to warn about the shortcomings and omissions of the system that are then reflected in the fates of children.

The BaBe Association calls on all Croatian and European parliamentarians to vote today, September 12, 2017, without delay in favor of ratifying the Council of Europe Convention on preventing and combating violence against women and domestic violence (the so-called Istanbul Convention). The aim of the Istanbul Convention is to protect women from all forms of violence and to prevent, punish and eliminate violence against women and domestic violence. The Istanbul Convention will contribute to combating all forms of violence and discrimination, promote gender equality and ensure a comprehensive framework of policies and measures for the protection and assistance of victims of all forms of violence against women, including domestic violence. The Convention also provides guidelines for supporting organizations and institutions in establishing effective cooperation and adopting a comprehensive approach to combating violence against women and domestic violence.

BaBe calls on the Croatian and European public to support the ratification of the Istanbul Convention and warns that they should reject any form of intentional and malicious misinterpretation of the spirit of this convention and not fall for false interpretations and statements by those who do not care about protecting our women, children and families.
